These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FleetPath, a subsidiary of Lavish Enterprises, Inc. (OTC: VXIT) ("FleetPath," "we," "our," or "us"). These Terms govern your access to and use of the FleetPath website, platform, applications, and related services (collectively, the "Service"). Please read these Terms carefully before using the Service.
By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must not access or use the Service. If you are using the Service on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms.
FleetPath provides an AI-powered fleet management operating system designed for trucking carriers and related stakeholders. The Service may include, but is not limited to, fleet tracking, route optimization, compliance management, document processing, billing and invoicing tools, and related operational features. The specific features and capabilities of the Service may change as we continue development and roll out new functionality.
The Service is intended for use by individuals who are at least 18 years of age and are legally capable of entering into binding agreements. By using the Service, you represent that you meet these eligibility requirements. We reserve the right to refuse service, terminate accounts, or cancel access at our discretion.

The FleetPath name, logo, and all related product and service names, design marks, and slogans are trademarks of FleetPath or its affiliates. You may not use these marks without our prior written permission.
No right, title, or interest in or to the Service or any content within it is transferred to you, and all rights not expressly granted are reserved by FleetPath.
You retain ownership of any data, documents, files, or other content you upload to or create within the Service ("User Content"). By uploading User Content, you grant FleetPath a non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing and improving the Service.
You represent and warrant that you own or have the necessary rights to all User Content you provide, and that your User Content does not violate the rights of any third party.
FleetPath is currently in a pre-launch phase and may offer access to beta or pre-release versions of the Service ("Beta Services"). Beta Services are provided on an "as is" and "as available" basis. You acknowledge that Beta Services may contain errors, bugs, or limitations and may not perform at the level of a commercially released product. We may modify, suspend, or discontinue Beta Services at any time without notice or liability.
Your participation in any beta program is voluntary, and you agree to provide feedback and report any issues encountered during your use of Beta Services. Any feedback you provide becomes the property of FleetPath and may be used without restriction or compensation.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. To the fullest extent permitted by applicable law, FleetPath disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any content or information provided through the Service. Any reliance on the Service is at your sole risk.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FLEETPATH, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you have paid to FleetPath in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00 USD).
You agree to indemnify, defend, and hold harmless FleetPath, Lavish Enterprises, Inc., and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) your User Content.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, limitation of liability, and indemnification.
You may terminate your account at any time by contacting us. Upon termination, we will make commercially reasonable efforts to provide you with a copy of your User Content upon request, subject to technical feasibility and applicable law.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in the State of California, and you consent to the personal jurisdiction of such courts.
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by posting the revised Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.
